On the date of the incident, a pick-up truck owned and controlled by the Defendant (a commercial pool company) operated by one of their drivers, not paying attending, crushed into the rear of the family vehicle of the Plaintiff. After police arrived and sited the other driver, Plaintiff left the scene by ambulance to the local hospital. She was initially diagnosed with pain and tenderness in the neck, shoulders, and back, and ordered to stay out of work until follow up. After initial round of physical therapy the pain and limitations only progressed and following additional imaging studies, she was finally diagnosed with need for spinal fusion. She was out of work for several months and incurred over $100,000 in medical expenses. The case settled for the policy limit before suit had to be filed.
